Trial updates (tl;dr: 10 am, Tuesday, April 6, 2021)

The hearing for the motion to suppress evidence, originally scheduled for tomorrow was cancelled, and a new hearing for a change of plea is now scheduled at 10 am on Tuesday, April 6, 2021, at the Fairfield County Court, in the East Courtroom.

A plea agreement was reached between the prosecutor and the defense.  It is expected to be a short hearing where:

  • The defendant changes the plea to guilty for some of the charges
  • The judge accepts the change of pleas.
  • The prosecutor asks for sentencing per plea agreement
  • The judge approves/disapproves the sentence.
  • The defendant is sentenced.

Going through the motion to suppress evidence would have eliminated the possibility of a plea agreement, leading to a full jury trial in May. Needless to say, a lengthy jury trial would not only be extremely costly, but a painful process for Bree and her children. Whatever the plea agreement will be, nothing will bring Shin back, anyway. However, we can move on sooner, whatever that means especially for Bree, Kai, and Ayla, without the pain of reliving the dreadful day for weeks.

I will be coming to Columbus to attend the hearing.

New trial date again: May4, 2021 at 9:00 am

The motion to continue the trial was granted, and the jury trial of the driver is now set to May 4, 2021 at 9:00 am. In addition, there is an additional hearing for a motion to suppress evidence was continued to March 23, 2021 at 1:30 pm.

Trial may be coontinued again.

On January 26, 2021, the defense attorney again filed a motion to continue the motion hearing to suppress evidence on February 2, and the jury trial scheduled to be on March 9, on the basis the plea negotiations are underway.

New Trial Date

The original jury trial date of January 26 was continued, as both the prosecutor and the defense are in plea negotiations. However, a jury trial date is now currently set to be on March 9, 2021.

Additional subpoenas have been issued for more witnesses as well. With the number of witnesses to be presented by the prosecutor approaching 30, it will be a long trial.

Nothing is gained through dragging Bree, Kai and Ayla through a prolonged trial. Shin will never be with us again. However, the legal system has failed the society already by letting the murderer walk and get behind a wheel impaired. The driver must be kept off the road and the society for a long time.

Criminal Trial continued

The criminal trial was originally scheduled to start on November 3, 2020, the Election Day. The defendant  filed a motion to extend the deadline for filing pretrial motion by the Defendant on September 21, and the court extended the deadline to November 23, 2020.

This means that the trial will likely be in 2021.

The Defendant is free on bail, and is seen on his brother's social networking account.
